Dates set to hear petition by soldier who lost sight

The Supreme Court has decided to take up a fundamental rights petition filed by a war veteran who is seeking Rs.10 million in damages after he lost vision in one eye during a demonstration.

Nishantha Mihiraj, a resident of Matara, through his petition claims that he lost vision in one eye when Police fired tear gas during a protest staged on the 7th of November in 2017, opposite the Presidential Secretariat.

Accordingly, he is seeking Rs.10 million in damages from the state.

The Minister of Defence, the Secretary of the Ministry of Defence, the Acting Inspector General of Police, the Officer-in-Charge of the Colombo Fort Police Station and the OIC of the Anti-Riot Squad.

Accordingly, the petition was taken up this morning before the Bench comprising of Justices Priyantha Jayawardene, Vijith Malalgoda and Yasantha Kodagoda.

The bench decided to take up the case once again on the 4th of May 2021.
