Court deems unnecessary to issue order to arrest Diana

Colombo Chief Magistrate Prasanna Alwis said that no arrest order will be issued for State Minister Diana Gamage, who has been accused of committing offences under the Immigration and Emigration Act.

The Magistrate said that the Criminal Investigation Department (CID) has the power to take measures related to the arrests under the offences of the Act.

The plaintiff Oshala Herath and the aggrieved parties’ lawyers in this case had previously stated in the court that the CID is not taking any steps to arrest Ms. Gamage despite the existence of sufficient evidence and requested to issue an arrest warrant in accordance with the powers given to the court under Section 32 of the Criminal Procedure Code.

The Magistrate said that the investigating officers have the authority to take action under the Criminal Procedure Code.

Therefore, the Magistrate said that it is unnecessary for the court to issue an order in this regard.
