Lawyer suspended for recording Easter Attack Commission evidence

The Supreme Court yesterday (24) ordered the suspension of the practice of a lawyer for a period of eight months after he was found guilty of recording an evidence inquiry by the Presidential Commission of Inquiry (PCoI) into Easter Sunday attacks.

This order was made after examining the facts related to a complaint filed by the secretary of the PCoI against the lawyer ‘Nizam Mohammad Shamin’, a resident of Akuressa.

It is stated in the decision that “Mohammed Mursia Marsha Mulla” was giving evidence on behalf of the “All Ceylon Jamiyathul Ulama” on September 9, 2020 before the PCoI. At that time, the respondent had recorded the proceedings with his mobile phone.

PCoI Secretary H.M.B.P. Herath had filed a complaint to the Supreme Court against the lawyer and a hearing was conducted under the violation of the Supreme Court Rules.

Pronouncing its decision, the Judge Bench stated that the twenty-third clause mentioned in the Supreme Court Rules has been violated by the actions of the lawyer.

Therefore, as a punishment, the bench has decided to order the suspension of the lawyer’s practice for a period of eight months from the first of January 2024.
